Information You Provide To Us
To enable you to enjoy certain features of Truband.com, we may collect certain types of information, including personally identifiable information, during your interactions with the Truband Services. For example, we may collect information when you:

• Register to use Truband.com;
• Take the Truband Personality Survey (which we call the "Truband Q");
• Enter information in your Profile Page, including your friends lists;
• Post comments on other Truband users' pages or use other community and social networking features that are part of Truband.com;
• Upload content to your Profile Page;
• Participate in polls, contests, or other features of Truband.com; and
• Sign up to receive email newsletters.

When you register, we ask you to provide your email address, birth year, gender, and zip code, as well as a password for your user account. You will also be required to complete the Truband Q, which is a 32 question personality survey. The Truband Q contains questions regarding your likes, dislikes and reactions to certain scenarios. If you choose to purchase merchandise, Virtual Currency or Virtual Goods on Truband.com, you will also be asked to provide your name, credit card information, address and zip code. When you contact us by email, we retain the emails that you send to us.

On Truband.com, you can order products and merchandise, purchase virtual currency and virtual goods, enter contests, vote in polls or otherwise express an opinion, or participate in one of our online forums or communities. In the course of these various offerings, we often seek to collect from you various forms of personal information. Examples of the types of personally identifiable information that may be collected at these pages include: name, address, e-mail address, telephone number, fax number, credit card information, and information about your interests in and use of various products, programs, and services.

Information Other People May Provide About You
You may also be able to submit information about other people. For example, if you order a gift online and want it sent directly to the recipient, you might submit the recipient/s name, address and telephone number. Examples of the types of personally identifiable information that may be collected about other people at these pages include: recipient/s name, address, e-mail address, and telephone number.

We may collect information about you from people who have stored information about you when they elect to use our social networking or community features, or when they enable connectivity with another website or application where they have stored such information. For instance, your friends may have stored information about you in places such as their friends lists, address books, or photos on our site and other sites with which Truband interacts.

We may also collect your email address when people you know share a station with you, but we will not add your name to any of our mailing lists as a result of this feature.

At certain parts of our site, only persons who provide us with the requested personally identifiable information will be able to order products, programs, and services or otherwise participate in the site/s activities and offerings.

Automatic Data Collection

Copyright Tracking: The Truband Service may incorporate software that is designed to protect the copyrights associated with the tracks you listen to and to ensure that artists and copyright owners receive applicable royalties. This software identifies and counts the songs you have accessed.

Service partners: When you access the Truband Services through a service partner, we may add select aspects of your registration information (such as your email address), so that we can recognize to which of our Partners or other sign-in pages to send to you when you log on to the Truband Services.

Tracking technology: We use what are commonly called "cookies," a small data string our server writes to your hard drive, and other tracking technology (such as Flash Persistent Storage) to help us manage and track your interaction with Truband Services. These technologies collect non-personally identifiable information to improve Truband Services to keep count of return visits to our site or our advertisers' or partners' sites, collect and report on aggregate statistical information, save your password and login information, and/or display advertising or content based on your interests. We may also capture other data such as search criteria and results, date, time, connection speed and IP addresses. Third parties whose products or services are accessible or advertised via the Truband Services may also use cookies, and we advise you to check their privacy policies for information about their cookies and other privacy practices.

We, our service providers, advertisers and partners may collect various types of non-personally identifiable information when you visit our site. Additionally, we may de-identify personally identifiable information and share it in a de-identified or aggregated form with third parties, advertisers and/or business partners in order to analyze site usage, improve the Truband Services and your listener experience, or for other similar purposes.

We may use the information you provide about yourself to fulfill your requests for our products, programs, and services, to respond to your inquiries about our offerings, to offer you other products, programs or services that we believe may be of interest to you, to enforce the legal terms that govern your use of our sites, and/or for the purposes for which you provided the information.

We sometimes use this information to communicate with you, such as to notify you when you have won one of our contests or when we make changes to our subscriber agreements, to fulfill a request by you for an online newsletter, or to contact you about your account with us.

We use the information that you provide about others to enable us to send them your gifts or cards. From time to time, we also may use this information to offer our products, programs, or services to them.

The information we collect in connection with our online forums and communities is used to provide an interactive experience. We use this information to facilitate participation in these online forums and communities and, from time to time, to offer you products, programs, or services.

How the information we collect is shared:

We will make your personally identifiable information available to other companies, websites, applications or people in the circumstances listed below.

• You provide information in the course of your use of the Truband Services by registering for Truband.com, taking the Truband Q, participating in community and social networking features such as forums, Profile Page, listener opinions and reviews, or other forms of public communication and interaction. In addition, we also make your profile page available to those registered users who know your email address and who specifically request your profile page.


• Select to allow us to share information at the time that you register with us or provide us with the information, or through a subsequent affirmative election.


• When we hire or partner with third parties to provide specialized services on our behalf, such as credit card processing, sweepstakes management and prize fulfillment, data processing, customer/support services and special products or services that we choose to make available to our registered users.


• When you search for artists or listen to music via the Truband Services. Unless you make your Profile Private, information about the artists, songs, and stations you have created or listened to may be made publicly available.

• When we jointly offer certain features or services with third parties, such as service partners that make features available through the Truband Services, business partners through whom we allow registered users to access Truband Services, advertisers, or marketing companies. When you use these features or services, you grant us permission to pass your Truband registration information back to that service partner. • When we work with a third party to provide personalization to the Truband Services through connectivity to another website or application. We may also share your information with a third party when we jointly offer a service or a feature with that third party, such as connectivity with other websites.


• If you unsubscribe for a mailing that we send to you on behalf of a third party, we may share your removal instructions with the third party so that your email address may be added to that company/s list of people to whom they will not send emails directly.


• In connection with a merger with another entity, or in the event of a transfer of all or some of our assets.

We may disclose personally identifiable information in response to legal process, for example, in response to a court order or a subpoena. Use of Truband outside of the United States is a violation of our Terms of Use. The laws on holding personal information in the United States may vary and be less stringent than laws of your state or country.
